Summary:
The court ruled that Tidewater Environmental Services Inc.'s proposed Wanendale plant is neither a manufacturing facility or a heavy industry site as defined by the Coastal Zone Act, the Delaware law controlling pollution near the Atlantic Ocean. The Sierra Club and other groups had appealed to prevent the company from building the plant, arguing it was a heavy industry and thus banned from the coastal zone.
